Standard Terms and Conditions
- Australian Visa Experts (AVE) will take necessary steps to obtain a client’s relevant instructions and documents to enable it to prepare the client’s visa application and lodge that application with the Department of Immigration and Citizenship [DIAC] as soon as possible.
- AVE will carry out its tasks in accordance with its standard performance guarantee
- AVE will require the Client to pay the following fees and charges –
- Whatever filing and processing fees are charged by DIAC for the particular visa application;
- AVE’s fees applicable to the visa being applied for.
- AVE’s fees will generally fall within the recommended range of fees for migration agents as published by the Migration Agents Regulation Authority (MARA) on its web site – see www.themara.com.au
- If AVE decides to apply a fee that is more than MARA’s recommended range it will disclose and explain the reason for this in its costs agreement with the client.
- AVE will enter into an individual written costs agreement with each client before it commences to carry out any work for the client.
- AVE’s cost agreement will disclose to the client all fees and charges payable by the client for the visa application and a timetable for payment of such fees and charges.
- AVE will not commence any work for the client until the costs agreement has been signed and returned by the client.
- Any money paid to AVE by the client prior to the lodgement of the visa application will be held by AVE in special clients - money bank account.
- Once the visa application has been lodged with DIAC and accepted by DIAC as a valid application AVE will write to the client to advise it of this fact and present the client with a final Invoice for AVE’s fees.
- If the client does not raise any objection to AVE being paid its invoice fee AVE will apply any of the client’s money held in the client money bank account to payment of the Invoice.
- If the client does raise an objection AVE will not apply any client money to payment of its Invoice until such time as it has dealt with the objection in accordance with the AVE Performance Guarantee
- If AVE does not satisfy its performance pledge to the client AVE will forgo its contract fee in full.
- If AVE does satisfy its performance pledge to the client then the client agrees that all fees due to PVS should be paid within 7 days of AVE lodging a valid visa application for the client.
